The application of the Highway Safety Code (chapter C-24.2) to a bus which has been inspected by the State of New York is subject to the Agreement between the Gouvernement du Québec and the Government of the State of New York respecting the mechanical inspection of buses, the text of which is attached hereto.

AGREEMENT BETWEEN THE GOUVERNEMENT DU QUÉBEC AND THE GOVERNMENT OF THE STATE OF NEW YORK RESPECTING THE MECHANICAL INSPECTION OF BUSES
THE GOUVERNEMENT DU QUÉBEC, represented by the minister of Transport and the minister of International Affairs,
AND
THE GOVERNMENT OF THE STATE OF NEW YORK, represented by the Commissioner of Transportation,
Hereafter called the Parties to this Agreement.
WHEREAS Québec and the State of New York seek to promote highway safety withing their own borders by implementing, in particular, periodic mechanical inspection programs;
DESIRING to facilitate the movement of traffic between Québec and the State of New York, while ensuring that the mechanical condition of road vehicles meets standards recognized by both Parties;
WISHING to eliminate, to the benefit of their residents, the inconvenience resulting from a double mechanical inspection;
AGREE TO THE FOLLOWING:
ARTICLE 1
DEFINITIONS
For the purpose of this Agreement:
“Bus” means a road vehicle designed for the transportation of more than 9 occupants at a time and used mainly for that purpose;
“Road Vehicle” means a motor vehicle that can be driven on a highway.
ARTICLE 2
PURPOSE
The purpose of this Agreement is the recognition, by each of the Parties, of the mechanical inspection of buses carried out within the jurisdiction of the other Party.
ARTICLE 3
SCOPE
This Agreement applies to buses which have been subject to a mechanical inspection carried out by the Régie de l’assurance automobile du Québec, the Commissioner of Transportation of the State of New York, or their authorized agents.
ARTICLE 4
CONDITIONS OF RECOGNITION
The mechanical inspection standards recognized for the purpose of this Agreement are those included in the regulations of each of the Parties which they hereby declare to have read and accepted.
Any minor changes in these standards are reputed to be recognized pursuant to this article.
ARTICLE 5
The mechanical inspection is certified by an inspection sticker, which will be recognized in the jurisdiction of each of the Parties for no more than 6 months following the date of issuance.
ARTICLE 6
ADMINISTRATIVE AUTHORITIES
Each of the Parties, under the responsibility of the Régie de l’assurance automobile du Québec and the Department of Transportation of the State of New York, determines the forms and procedures necessary to administer this Agreement.
ARTICLE 7
INFORMATION
The Parties are to provide each other with any information or documents necessary to enforce this Agreement. They are to keep each other informed of any changes in Federal, State or Provincial laws or regulations which may affect the terms of this Agreement.
ARTICLE 8
MISCELLANEOUS PROVISIONS
This Agreement does not invalidate any provision of a law, a regulation or any other reciprocal agreement relating to the mechanical inspection of road vehicles in effect in either jurisdiction.
ARTICLE 9
This Agreement shall remain in force until one of the Parties informs the other by written notice within 6 months of its intention to withdraw.
In the event of withdrawal, the mechanical inspections carried out prior to the expiry date of the Agreement will continue to be recognized in accordance with the provisions of this Agreement.
ARTICLE 10
This Agreement will be effective upon formal notice on a date acceptable to both Parties, after the required internal procedures are completed.
